Acceptance of Terms

By accessing, browsing, creating an account on, or purchasing from the Evorece website or any associated platform, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety.

If you do not agree to these Terms & Conditions, you must immediately discontinue your use of our platform. Continued use of the website constitutes your ongoing acceptance of these terms and any future modifications thereto.

These Terms & Conditions constitute a legally binding agreement between you ("Customer," "User," or "You") and Evorece ("Brand," "We," "Us," or "Our"). We reserve the right to revise these terms at any time, and your continued use of the platform following such changes signifies your acceptance of the revised terms.

Account Registration

To place an order on the Evorece platform, customers are required to create a registered account. By registering, you confirm that all information provided is accurate, current, and complete to the best of your knowledge.

You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password. Any and all activity that occurs under your account shall be considered your responsibility, whether or not authorised by you. Evorece shall not be held liable for any loss or damage arising from your failure to safeguard your account information.

Should you suspect any unauthorised access or breach of your account, you must notify us immediately at customerservice@evorece.com. Evorece reserves the right to suspend or terminate accounts that violate these terms or are suspected of fraudulent activity.

Product Information

Evorece endeavours to present accurate and comprehensive product information, including descriptions, sizing guides, care instructions, fabric compositions, and visual representations. We take pride in the authenticity and quality of our product listings.

However, it should be noted that colours, shades, and textures as displayed on our platform may differ slightly from the actual product due to variations in monitor settings, screen calibration, ambient lighting, and photographic conditions. Such minor colour or shade variations shall not constitute grounds for a return unless the product materially differs from its stated description.

Product availability is subject to change without prior notice. Evorece reserves the right to discontinue any product at any time. Descriptions, specifications, and product categories may be updated or expanded as the brand evolves.

Pricing & Payments

All prices listed on the Evorece platform are denominated in Indian Rupees (INR) and are inclusive of applicable taxes unless explicitly stated otherwise. Prices are subject to change at any time without prior notice, and Evorece shall not be obligated to honour a price that was listed in error or has since been updated.

Evorece accepts a wide range of secure payment methods including, but not limited to: UPI (Unified Payments Interface), Credit Cards, Debit Cards, Net Banking, Digital Wallets, Cash on Delivery (COD), and any other payment methods made available on the platform from time to time.

Payment must be completed in full at the time of order placement, except in the case of COD orders. All transactions are subject to verification and authorisation by the respective payment provider. Evorece reserves the right to cancel any order where payment verification fails or is suspected of fraud.

Shipping & Delivery

Evorece currently offers delivery services across India. Delivery timelines are estimates and may vary based on your location, product availability, logistical conditions, public holidays, or unforeseen circumstances such as weather disruptions or carrier delays. Estimated delivery dates communicated at checkout are indicative and not guaranteed.

Orders are dispatched within the timeframe specified on the product page or order confirmation, subject to stock availability. Once dispatched, you will receive a tracking notification to monitor your shipment.

Evorece is not responsible for delays caused by third-party logistics partners, incorrect delivery addresses provided by the customer, or events beyond our reasonable control. In the future, Evorece may extend shipping to international destinations; any such expansion will be communicated through our platform with applicable terms and conditions.

Returns & Exchanges

Evorece offers customers the right to request a return or exchange within 7 (seven) days of the confirmed delivery date. To be eligible, the product must be unused, unwashed, undamaged, and free from any alterations. All original tags must remain intact, and the product must be returned in its original packaging.

Customers must initiate return or exchange requests by contacting our support team at customerservice@evorece.com within the stipulated period, providing the order details and reason for the request. Upon receipt and inspection of the returned product, Evorece will process the exchange or issue a refund in accordance with our Refund Policy.

Sale items and products purchased at a discount are also eligible for returns and exchanges in accordance with this policy, provided all conditions stated herein are met. Evorece reserves the right to decline a return or exchange if the product does not meet the stated conditions upon inspection.

Order Cancellation

Customers may cancel an order prior to its shipment by contacting our support team at customerservice@evorece.com or through the cancellation option available in their account dashboard, where applicable.

Once an order has been dispatched, cancellation is no longer possible through standard channels. In such cases, customers may refuse delivery at the time of receipt as an alternative means of cancellation. Refused deliveries will be returned to our warehouse and treated as return requests, subject to our Refund Policy.

Refunds for cancelled orders will be processed within a reasonable timeframe in accordance with Evorece's Refund Policy. The mode of refund may vary based on the original payment method used at the time of purchase.

Cash on Delivery (COD)

Cash on Delivery (COD) is available on eligible orders at the discretion of Evorece. Customers selecting this option agree to make full payment to the delivery personnel at the time of receipt of the order.

Evorece reserves the right to restrict COD as a payment option for customers who repeatedly refuse, return, or fail to accept COD orders without valid cause. Such restrictions are implemented to maintain service integrity and operational efficiency.

In the event of a refused or returned COD order, an Evorece representative may contact the customer to understand the reason for refusal and to resolve any concerns. Continued misuse of the COD facility may result in permanent restriction of this payment option for the concerned account.

Right to Refuse or Cancel Orders

Evorece reserves the absolute right to refuse, cancel, or limit any order at its sole discretion, without prior notice or obligation to provide a reason. This right may be exercised in circumstances including but not limited to: suspected fraudulent activity, misrepresentation of information, pricing or technical errors on our platform, violation of these Terms & Conditions, bulk or commercial purchasing contrary to our policies, or any activity deemed suspicious or detrimental to the interests of the brand and its customers.

In the event that an order is cancelled by Evorece after payment has been received, a full refund will be initiated through the original payment method. Evorece shall bear no liability beyond the refund of the order value in such cases.

Intellectual Property

All content featured on the Evorece platform, including but not limited to brand name, logo, wordmarks, product images, graphic designs, website layout, user interface, written content, product descriptions, styling photography, and any other creative material, is the exclusive intellectual property of Evorece and is protected under applicable Indian intellectual property laws.

No content from this platform may be reproduced, copied, distributed, modified, published, transmitted, displayed, or used in any manner without the prior written consent of Evorece. Unauthorised use of our intellectual property constitutes an infringement and may result in legal action.

By submitting any content, reviews, or communications to Evorece, you grant us a non-exclusive, royalty-free, perpetual licence to use, display, and share such content in connection with our brand and services.

Limitation of Liability

To the fullest extent permitted by applicable law, Evorece, its directors, employees, partners, agents, and affiliates shall not be held liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of or inability to use our website, products, or services, even if Evorece has been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of the platform or purchase of products shall be limited to the amount paid by you for the specific product or service that is the subject of the claim. Evorece does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful elements.

This limitation of liability does not affect any statutory rights you may have as a consumer under applicable Indian consumer protection laws.

User Conduct

Users of the Evorece platform agree to access and use the website solely for lawful purposes and in accordance with these Terms & Conditions. You must not engage in any conduct that is harmful, fraudulent, deceptive, or disruptive to our platform, other users, or our business operations.

Prohibited activities include but are not limited to: attempting to gain unauthorised access to our systems or data; uploading or transmitting malicious code, viruses, or harmful software; scraping, crawling, or extracting data from the platform without express authorisation; impersonating any person or entity; or engaging in any activity that interferes with the proper functioning of our website.

Evorece reserves the right to take immediate action against users who violate these conduct guidelines, including account suspension, order cancellation, and reporting to relevant authorities.

Privacy

Evorece is committed to protecting the privacy and security of our customers' personal information. All data collected through your use of our platform, including personal details, payment information, browsing behaviour, and order history, is handled in accordance with our Privacy Policy.

By using the Evorece platform, you consent to the collection, storage, and use of your personal information as described in our Privacy Policy. We do not sell or rent your personal data to third parties and take reasonable measures to safeguard your information from unauthorised access.

Modifications to Terms

Evorece reserves the right to amend, update, or modify these Terms & Conditions at any time and at its sole discretion, without obligation to provide prior notice. Any changes will be effective immediately upon publication on the platform.

It is your responsibility as a user to review these Terms & Conditions periodically to remain informed of any updates. Your continued use of the Evorece platform following the posting of any changes constitutes your acceptance of and agreement to the modified terms.

Material changes to these terms, where reasonably practicable, may be communicated via email to registered customers or through a notice on the website. However, Evorece does not guarantee that all users will be individually notified of every update.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by, construed, and interpreted in accordance with the laws of India, without regard to conflict of law principles. Any disputes, claims, or controversies arising out of or in connection with these terms, or the use of the Evorece platform or products, shall be subject to the exclusive jurisdiction of the competent courts of India.

By using our platform, you irrevocably consent to the jurisdiction and venue of such courts and waive any objections to the exercise of such jurisdiction or venue. These terms do not limit any consumer rights you may have under applicable Indian consumer protection legislation.

If any provision of these Terms & Conditions is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
